US to Spain FULBRIGHT PROGRAM PARTICIPANTS: WE REQUEST YOUR EXPLICIT CONSENT TO USE YOUR SENSITIVE PERSONAL DATA

Who we are

The US-Spain Binational Fulbright Commission (the “Commission”) requires that you provide certain sensitive personal data that we will process in order to conduct the program activities that are part of your Program. Under data protection law, we require your explicit consent to do so.

In administering the Program, we may work with the Bureau of Educational and Cultural Affairs of the United States Department of State («ECA«) and/or U.S. Embassy Posts (“Post”). This consent applies only to the Commission, although in some cases, the data processing activities may be carried out in conjunction with the Institute of International Education (IIE), ECA or Post, given their involvement in the Program.

What sensitive personal data will we request?

We may collect and process sensitive personal data which you provide to us in connection with the following processing activities carried out by The Commission:

  • Record creation/management
  • Background check
  • Grant management
  • Medical Review
  • Financial management
  • Travel management
  • Insurance Management
  • Event coordination
  • Program promotion
  • Participant progress monitoring
  • Program reporting
  • Program evaluation

Sensitive Personal Data that you may have voluntarily provided during the Application and Selection phases of the Fulbright award competition will be used for the creation of participant records by the Commission.

Furthermore, we may request: biometric data for the processing of documents necessary for visa sponsorship; a medical form indicating your medical history; information relating to criminal convictions and offences or related security measures as required by the Fulbright Terms and Conditions contract; and information on dependents, including children.

This sensitive personal data could include the following (the «Sensitive Personal Data«):

  • Information concerning your health;
  • Information about your political views (if and as volunteered);
  • Information about your sexual orientation (if and as volunteered);
  • Data revealing racial or ethnic origin (if and as volunteered);
  • Political, religious or philosophical beliefs (if and as volunteered);
  • Trade union membership (if and as volunteered);
  • Genetic data or biometric data
  • Information on dependents, including children, as appropriate
  • Information relating to criminal convictions and offences or related security measures

Please note that we will not be using the Sensitive Personal Data to make decisions about you based solely on automated processing, including profiling.

Who else will be relying on your consent to process this data?

If you provide us with your explicit consent, the following third parties (the «Third Parties«) will process your Sensitive Personal Data for the processing activities listed above:

  • ECA, Post or IIE
  • Spanish public or private educational, academic and research institutions
  • National and Regional Administrations from Spain.
  • Participant insurance providers/claims processors (including 7 Corners and CISI)

You can withdraw your consent

If you give your consent, you can change your mind and withdraw it later on at any time by e-mailing us at the address below. If you do so, we will stop processing your Sensitive Personal Data and delete it from our systems permanently to the extent we can do so in accordance with applicable law. Please note that the withdrawal of your consent will not affect the lawfulness of the use of the Sensitive Personal Data before your consent was withdrawn.

Consequences of not providing the above sensitive personal data or withdrawing consent.

You do not have to provide your consent. However, please be aware that if you do not provide your consent or if you withdraw your consent later on, we might not be able to allow you to participate in the Program. This is because the collection, processing and retention of the Sensitive Personal Data is necessary under the Fulbright Award Terms and Conditions, Spain´s visa sponsorship requirements, and the requirements of Spanish academic institutions.
